No. KP/20/2021/PRR/10/2014/106/KH:- In exercise of the powers conferred by sub-section (5) of section 227 read with section 274 of the Gujarat Panchayats Act, 1993 (Guj.18 of 1993) and in supersession of all the rules made in this behalf, the Government of Gujarat hereby makes the following rules for regulating the method of Examination for recruitment to the different posts specified in Schedule I of the Gujarat Panchayats Services Classification and Recruitment (General) Rules, 1998,
falling under superior Panchayat Service (Class III), namely:-
1. Short title and application.-
(1) These rules may be called the Gujarat Panchayat Services (Class III) Recruitment (Examination) Rules, 2021.
(2) These rules shall apply to the recruitment to the posts specified in Schedule-I of the Gujarat Panchayats Services Classification and Recruitment (General) Rules, 1998.
2. Definitions.- In these rules, unless the context otherwise requires, -
(a) “Act” means the Gujarat Panchayats Act, 1993;
(b) “Annexure” means an annexure appended to these rules;
(c) “Board“ means the Gujarat Panchayat Services Selection Board constituted under section 235 of the Act;
(d) “Candidate” means a person who fulfills the criteria of eligibility as specified in the recruitment rules of the post concerned ;
(e) “Development Commissioner” means office of the Development Commissioner, Gujarat State;
(f) “Examination” means the examination prescribed under these rules;
(g) “Government” means the Government of Gujarat;
(h) “Panchayat Service “ means the Panchayat service as constituted under section 227 of the Act.
3. Educational Qualification and Age Limit .-
The candidate who possesses the requisite educational qualification, other qualification and requirements for the appointment to the posts as specified in Appendix A and Appendix B appended to these rules, prescribed under the relevant recruitment rules shall be eligible for admission to the Examination.
4. Advertisement of vacancies and Invitation of Applications.-
The Board on receiving the requisition from the Development Commissioner through Panchayats, Rural Housing and Rural Development Department, shall as far as practicable advertise on website the vacancies of the post(s), to be filled up with detailed instructions and invite online applications from the aspiring candidates. However, the Board shall also publish a short advertisements in the prominent newspapers widely circulated in the state, for the information of the aspiring candidates.
5. Holding of the Examination.-
The Board shall hold an examination for the purpose of selection of candidates for recruitment to the posts specified in Schedule-I of the Gujarat Panchayats Services Classification and Recruitment (General) Rules, 1998.
6. Candidate to bear expenses.-
The candidates shall have to appear at the examination at their own expense.
7. Syllabus of the Examination.-
The Syllabus of the examination shall be such as specified in Annexure- A and Annexure –B.
8. Medium of examination.-
The medium of examination shall be such as specified in Annexure - A, and Annexure-B.
9. Fees for the application form and examination.-
(1) A candidate shall be required to pay the application fee and examination fee, if any, determined by the Government from time to time.
(2) A candidate belonging to the Scheduled Castes, Scheduled Tribes or Socially and Educationally Backward Class (including Nomadic Tribes and denotified Tribes) or Economically Weaker Sections or a candidate who is Physically Disabled or as Ex-serviceman shall be exempted from paying application fee and examination fee, if any, in accordance with the rules prescribed or orders issued by the Government in that behalf.
(3) A candidate belonging to the Scheduled Castes, Scheduled Tribes, Socially and Educationally Backward Class (including Nomadic Tribes and denotified Tribes) or Economically Weaker Sections or a candidate who is Physically Disabled or an Ex-serviceman shall be required to produce a necessary proof for such exemption from an authority prescribed by the Government in this behalf.
10. Date, place, and time of examination.- The examination shall be held at such places as may be fixed by the Board. The Board shall decide the date, place, and time of the examination and shall intimate the candidate about the same.
11. Qualifying standard/ aggregate marks for the selection.- The qualifying standard/ aggregate marks for the selection shall be determined by the Board category-wise, considering the number of vacancies of respective category and merit list of candidates of the respective category.
12. Restriction as to examination.-
(1) The blind candidate shall be allowed to write in the examination with the help of a scribe subject to such instructions as may be issued by the Board on that behalf from time to time.
(2) A candidate shall not be permitted to carry with him a Cellular phone, pager or any other mobile communication device or any electronic gadget.
13. Board’s decision final.-
The decision of the Board as to the eligibility of a candidate for admission to the examination shall be final and the candidate who has not been permitted to appear at the examination by the Board shall not be allowed to appear at the examination.
14. Declaration and Publication of final Select List and Recommendation List and waiting list.-
(1) The Board before declaring and publishing the final Select List and Recommendation List on the basis of the result of the examination shall declare and publish the provisional results and ask the successful candidates to produce the certificates and testimonials for verification and after such verification, the candidates who are found eligible for the post(s) will be called by the Board in order of merit rank of the category in which he is selected and asked to choose the district and/ or post for appointment from amongst the districts and posts available in the respective category by the time his turn comes, and will be allotted the district and post, if they are available, considering his merit rank. If the candidate does not choose or refuses to choose the district and/or post from the available districts and/or posts considering his merit rank in the respective category, it will be treated as his permanent withdrawal of candidature and no claim or dispute in the matter will be entertained at a later stage by the Board.
(2) After such verification and allotment of the district and/or post for an appointment, the Board shall prepare and declare the final Select List and Recommendation List covering the names of candidates who are found eligible and suitable for the post and forward the same to the concerned appointing authority. At the same time, the Board shall put it on the website and the notice board at the office of the Board.
The names of candidates who are selected for the post(s) shall be arranged in order of their merit on the basis of the aggregate marks obtained in the examination by each candidate: Provided that the Board shall declare and publish a waiting List and Recommendation List covering the names of remaining meritorious candidates who are found eligible and suitable for the post(s), if required, to bridge the gap created by the candidates not joining the post(s) of appointment or by the resignation of the selected candidate or by the death of the selected candidate, considering the rules and regulation made by the Government in this behalf: Provided further that the waiting list and Recommendation List
referred to as above, shall be limited to 20% (twenty percentage) of total vacancies mentioned in the advertisement and it shall be operative for a period of two years from the date of publication of the final select list, or till the day immediately before the date of publication of the result of the next recruitment of respective cadre, whichever is earlier.
(3) The select list shall be forwarded to the District Development Officers with recommendation of the Board for the purpose of appointment to the post in respective category strictly in accordance with the order of merit of the candidate in the select list and copy of the select list shall be sent to the Government in Panchayats, Rural Housing and Rural Development Department on the same day.
15. Result of Examination.-
(1) The result of the candidates, whose names are to be recommended to the District Panchayat for the appointment shall be arranged according to the order of merits of candidates along with the seat number and the total marks obtained by each of the candidates and the copy of the result so published shall be sent to the Government in Panchayats, Rural Housing and Rural Development Department on the same day.
(2) The Board shall also display on its website the result of unsuccessful candidates containing the names, seat number, and total marks obtained by each of the candidates.
16. Disciplinary actions.- The candidate who is or has been declared by the Board to be guilty of –
(i) obtaining support for his candidature by any means;
(ii) impersonating;
(iii) procuring impersonating by any person;
(iv) submitting fabricated documents or documents which have been tampered with;
(v) making statements which is incorrect or false or suppressing material information;
(vi) resorting to any other irregular or improper means in connecting with his candidature for the examination;
(vii) using unfair means during the examination;
(viii) writing irrelevant matter, including absurd language or pornographic matter in the scripts;
(ix) misbehaving in any other manner in the examination hall;
(x) harassing or doing bodily harm to the staff employed by the Board for the conduct of the examination;
(xi) attempting to commit or as the case may be, abetting the Board of all or any of the acts specified in the foregoing clauses; or
(xii) violating any of the instructions issued to the candidates for admission to appear in the examination as specified in the admission certificate may, in addition to rendering himself liable to criminal prosecution, be liable-
(a) to be disqualified by the Board from the examination for which he is a candidate, or
(b) to be debarred either permanently or for a specific period,
(i) by the Board from appearing in any examination or from any interview for direct selection to be held by them; or
(ii) by the State Government from any employment under it : Provided that no penalty under clause (a) or clause (b) shall be imposed except after giving the candidate an opportunity of making such representation in writing as he may wish to make in that behalf;
(c) to disciplinary action under the appropriate rules if he is already in Government service.
17. Physical fitness test for qualified candidates.-
The candidates qualified for appointment shall be required to undergo a medical test of physical fitness in accordance with the provisions contained in the Gujarat Panchayats Services Classification and Recruitment (General) Rules, 1998 so as to be eligible for appointment.
18. Success in an examination not to confer right.-
The mere success in the examination shall not by itself confer any right to appointment. It shall be open
to the Board to cancel the selection/appointment of a candidate if, after such inquiries as considered necessary as per the provisions of the Gujarat Panchayats Services Classification and Recruitment (General) Rules, 1998, it is satisfied that the candidate is not suitable for Panchayat Service.
19. Candidates to join duty on being appointed.-
If the selected candidate has been given an appointment by the appointing authority fails to join his duties as directed in the appointment order, his appointment shall be liable to be canceled and his name shall be struck off from the select list.
20. Mark-Sheet and Rechecking of marks.-
(1) A candidate who desires to obtain the mark-sheet of the examination shall apply to the Board along with such fee as may be fixed by the Board within a period of fifteen days from the date of declaration of the final result of the examination.
(2) A candidate who desires to recheck his marks of examination, may apply to the Board along with such fee as may be fixed by the Board with a period of forty-five days from the date of declaration of the final result of the Examination.
